CONDITIONS OF ENTRY
YOU GOT FLIPPED
- Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each Eligible Entrant. Entry is via Internet only.
- Entry is free and open to residents of Australia and New Zealand aged 18 years or older (Eligible Entrant).The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, service providers and agencies associated with this promotion are ineligible to enter the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The Promoter is conducting two separate promotions. The first is a game of chance promotion and the second is purely a game of skill promotion.
GAME OF CHANCE
- Game of Chance “Weekly Prize Draws” promotion commences at 12:01 am (Sydney time) on 16/11/09 and closes at midnight (Sydney time) on 27/12/2009 (Game of Chance Promotional Period). Entries close for each Game of Chance Weekly Prize Draw on the dates and times specified in Condition 7. The Game of Chance Weekly Prize Draws will take place at Anisimoff Legal Level 4, 448 St Kilda Road, Melbourne VIC 3004 at the times and dates specified in Condition 7. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter. Winners will be notified by telephone and in writing (mail or email). Winners’ names and localities will be published on the Promotional Websites. The Promoter’s decision is final and no correspondence will be entered into.
- To enter the Game of Chance Weekly Prize Draw Eligible Entrants must, during the Game of Chance Promotional Period, register their details by logging on to either: (i) www.YouGotFlipped.com.au or www.DoYouFlip.com.au (for Australian residents) or (ii) www.YouGotFlipped.co.nz or www.DoYouFlip.co.nz (for New Zealand residents) (Promotional Websites) and correctly complete and submit the online entry form as required, including providing the Eligible Entrant’s full name, date of birth, gender, residential address, phone number and current and valid email address (Registration).
- Eligible Entrants will automatically be awarded one (1) entry into the relevant Game of Chance Weekly Prize Draw for each valid Registration and in accordance with Condition 7. Up to three (3) Registrations permitted per household, however only one (1) Registration permitted per Eligible Entrant. Any subsequent entry by an Eligible Entrant after the first valid entry received will be deemed invalid.

- For each Game of Chance Weekly Prize Draw, the first valid entry randomly drawn from all eligible entries received (Australian and New Zealand combined) during the relevant Game of Chance Weekly Prize Draw week will each win one (1) FLIP Mino HD Video Camera valued at AUD$300.00/NZ$340.00 Prize value is Recommended Retail Price including GST).
- Entries for a given Game of Chance Weekly Prize Draw that are not drawn as a winning entry for that Weekly Prize Draw will automatically be entered in to any subsequent Weekly Prize Draws (if any).
- Total maximum prize pool value for the Game of Chance Weekly Draws AUD$1,800.00/NZ$2,040.00. The prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
- In respect of the Game of Chance “Weekly Prize Draws”, the Promoter may conduct such further draws at the same place as the original draw as is necessary at 11:00 am (Sydney time)/1:00 pm (NZ time) on 19/4/2010 in order to distribute any prizes if unclaimed by that date, subject to any written directions given under applicable legislation. In the event of any winner(s) in the unclaimed prize draw, the winner(s) will be notified by telephone and in writing (mail or email) and their name and locality will be published on the Promotional Websites.
GAME OF SKILL
- The “Game of Skill” promotion commences at 12:01 am (Sydney time) on 16/11/09 and close at 12:00 midnight (Sydney time) on 29/1/2010 (Game of Skill Promotional Period). This element of the promotion is a game of skill and chance plays no part in determining the winner.
- To submit an entry for the Game of Skill promotion, Eligible Entrants who have successfully completed Registration must follow the prompts to the Game of Skill promotion entry page on the applicable Promotional Websites, upload their movie demonstrating their favorite or funniest moment, and submit the fully completed entry form as required. Uploaded files must be submitted in MOV, AVI, MP4, MPA, MPE, MPG, MPEG, QT or WMV format, must not exceed 80 MB file size and must be submitted during the Game of Skill Promotional Period (Game of Skill Entry).
- Game of Skill Eligible Entrants will automatically be awarded one (1) entry into the Game of Skill promotion for every valid and unique video submitted online as a Game of Skill Entry.
- Each entry will be individually judged based on originality, humour and creative merit of the video submitted. The best entry will be determined by a panel of appropriately qualified judges on 3/2/2010 at Cisco Sydney Level 9 80 Pacific Highway, North Sydney NSW 2060. The Game of Skill Prize will be announced and awarded on 18/01/2010. The judges may select additional reserve entries which they determine to be the next best, and record them in order, so that in the event that there is an invalid entry or ineligible entrant is selected as the provisional winner, the next best and valid reserve entry may be awarded the Game of Skill Prize. All reasonable steps to notify the Game of Skill winner of the results of the judging will be taken by the Promoter. The Game of Skill winner will be notified by telephone and in writing (mail or email). The Game of Skill winner will have their name and locality published on the Promotional Websites.
- The Game of Skill winner will be awarded a trip for three (3) adults to Las Vegas, USA, valued at up to AUD$11,000.00/NZ$13,862.00 (including GST, depending on point of departure) (Game of Skill Prize). The Game of Skill Prize includes:
- Three (3) adult return economy airfares to Las Vegas, USA from the Australian or New Zealand capital city closest to the ordinary residential address of the winner. Prize includes airfare related taxes and charges;
- Seven (7) nights for three (3) adults at four (4) star accommodation in Las Vegas, USA;
- return airport/accommodation transfers;
- travel insurance (if eligible); and
- AUD$1,000 spending money for the winner only.
- Additional spending money, meals, taxes, additional insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Game of Skill Prize must be taken by 30/11/2010 and is subject to booking and flight availability. Blackout periods may occur.
- All costs not disclosed in these Conditions of Entry including, but not only, additional meals, beverages, laundry services, spending money, transport to and from departure point, taxes (including applicable arrival and departure taxes), insurance and all other ancillary costs incurred in acceptance and use of the game of skill travel prize are the responsibility of the winner and their travel companion or companions (as the case may be). Use of any passes and vouchers issued as part of the travel prize are subject to prevailing terms and conditions of use and are only valid for use within the stated duration on the passes or vouchers issued or the duration of the winner’s prize, whichever is earlier.
- Acceptance of the travel prize is subject to any prevailing terms and conditions of travel prize component providers (if any), and may include health, behaviour, age and safety requirements. No compensation will be provided to the winner or their travel companion(s) (as the case may be) if they are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, age, behaviour or safety reasons.
- The winner (and his/her companions) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner (and his/her companions) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Game of Skill Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
- Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the Game of Skill Prize has been booked, take the Game of Skill Prize or element of the Game of Skill Prize at the time stipulated, then the Game of Skill Prize or that element of the Game of Skill Prize will be forfeited and will not be redeemable for cash.
- By entering this promotion, an Eligible Entrant absolutely and unconditionally assigns (and agrees to use their best endeavours to procure any relevant third parties to absolutely and unconditionally assign) all right, title and interest in all Intellectual Property Rights in their Game of Skill entry. Each Eligible Entrant must, upon request by the Promoter, execute all documents and perform all acts necessary to vest all Intellectual Property Rights in their entry in the Promoter. The Eligible Entrant expressly acknowledges and agrees that the Promoter (or its agencies) may record and reproduce on digital media, film, tape, photograph and by other means, the Eligible Entrant’s image or video. The Promoter (or its agencies) may use the image or video (in whole or part) and in any way in any media in Australia, including on the Promotional Websites for the purposes of marketing and promoting the Promoter’s brands and product lines without the further consent of the Eligible Entrant and without any payment or compensation payable to the Eligible Entrant. The Promoter (or its agencies) may edit the image or video in any way and may modify, adapt, alter and create derivative works from the image or video.
- Each Eligible Entrant expressly consents to the Promoter and its successors, licensees, and assigns, and anyone authorised by them, changing, copying, adding to, taking from, adapting and/or translating, in any manner or context, the image or video notwithstanding that such conduct may infringe moral rights (or similar) laws in any territory or jurisdiction, and, to the extent lawfully possible, provides a waiver in the moral rights in Game of Skill Entry.
- An Eligible Entrant agrees that, if they are declared a winner they will not disclose any information whatsoever (creative or otherwise) about their entry without the Promoter’s prior written approval in each instance. Any disclosure whatsoever about their entry without the prior written approval of the Promoter may subject that Eligible Entrant to substantial monetary damages. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by the Eligible Entrant, the Eligible Entrant agrees to indemnify the Promoter for those losses, damages and costs.
- All right, title and interest in all Intellectual Property Rights in all of the Promoter’s brands, logos, trading names and products will remain or be vested in the Promoter. Participation in this promotion by an Eligible Entrant will not, under any circumstances, be taken to constitute a transfer, assignment or grant of any ownership rights in any of the Promoter’s brands, logos, trading names and products. The Promoter, on a case by case basis and to the extent required, grants to each Eligible Entrant a non-exclusive licence for the Game of Skill Promotional Period to use of the Promoter’s brands, logos, trading names and products solely for the purpose and to the extent necessary, to enable each Eligible Entrant to create their Game of Skill entry.
- In these Conditions of Entry: “Intellectual Property Rights” means all existing or future intellectual property rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents), trade marks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable, and includes the right to apply for the registration of such rights, and whether existing in Australia or otherwise. “Laws” means all laws including rules of common law, principles of equity, statutes, regulations, proclamations, ordinances, by-laws, rules, regulatory principles and requirements, statutory rules of an industry body, statutory mandatory codes of conduct, writs, orders, injunctions, judgments, and Australian generally accepted accounting principles. “Losses” means loss, damage, liability, charge, expense or cost (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind. “Regulators” means any regulatory agency or any private entity that functions in a quasi-regulatory manner, having any applicable jurisdiction and includes the Advertising Standards Bureau, the Australian Association of National Advertisers, the Australian Communications and Media Authority, the Commonwealth Department of Broadband, Communications and the Digital Economy, the Australian Competition and Consumer Commission, the Office of the Privacy Commissioner, the Classification Board, the Telecommunications Industry Ombudsman and any authority, agency or entity that is substituted for, or takes over the functions of, any of those organisations.
- Any entry in the Game of Skill promotion that contains content that the Promoter, in its sole discretion, considers to be one or more of the following content types will not be considered eligible entries into the promotion:
- content that depicts, alludes to or promotes offensive or illegal behaviour;
- content that is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- content that harasses or advocates harassment of another person;
- content that exploits people in a sexual or violent manner;
- content that contains nudity, violence, or offensive subject matter or contains a link to an adult website;
- content that solicits personal information from anyone under 18;
- content that provides any telephone numbers, street addresses, last names, URLs or email addresses;
- content that promotes information that an Eligible Entrant knows is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
- content that promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
- content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spamming";
- content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
- content that solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
- content that involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
- content that contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
- content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;
- content that includes an image or reference to another person that you have submitted without that person's consent; or
- content that uses sexually suggestive imagery or any other unfair, misleading or deceptive content.
- By entering into the Game of Skill promotion, each Eligible Entrant warrants to the Promoter:
- that they have the rightful power and authority to submit their entry in the name stated;
- that they own the content of their entry and have the right to assign copyright ownership and other Intellectual Property Rights in the entry to the Promoter;
- that their entry does not violate the privacy rights, copyright, contract rights or other rights (including but not limited to Intellectual Property Rights) of any person, corporation or entity;
- in respect of entries that include images or references to third parties or third party property, that they have obtained the required written consents and releases from those third parties (or third party property owners) including moral rights consents, to include them in their entry and submit that entry into this promotion before submitting their entry;
- in respect of entries that include images or references to third parties, that the third party participant has been informed by the Eligible Entrant and agrees in writing that their image or reference may be used by the Promoter in any media for an unlimited period of time without remuneration or compensation to the third party participant for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter;
- that their entry does not contain content that is illegal, contrary to any Laws, indecent, obscene, threatening, discriminatory, harassing, in breach of any confidence, defamatory, libellous, offensive or objectionable;
- that their entry does not contain content that is contrary to the requirements or directions of relevant Regulators;
- that their entry does not contain content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;
- that their entry does not contain content that contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
- that their entry does not contain any misrepresentations or suggestion that any entity has the approval or sponsorship of any other entity which it does not have;
- that during the course of creating their entry, their conduct was not illegal, contrary to any Laws, indecent, obscene, threatening, discriminatory or harassing to any person; or
- that the Eligible Entrant agrees that if their entry is accepted by the Promoter, it will be available on the Promoter’s website for public viewing and that their entry may be used by the Promoter in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome).
GENERAL
- Incomplete, ineligible or incomprehensible entries into the promotion will be deemed invalid. Internet entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission.
- The Promoter’s decision in relation to the determination of winners and judging criteria (if applicable) or any other element of this promotion is final and no correspondence will be entered into.
- The Promoter makes no warranties and accepts no liability in relation to each prize, its condition or fitness for any purpose. All claims should be directed to the applicable manufacturer or issuer and not the Promoter.
- Verification: A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
- Liability: The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss and loss of opportunity), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) except for in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law) in connection with (a) taking any prize or using any prize; (b) prizes damaged or lost in transit; (c) any theft, unauthorised access or third party interference; or (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter). The Promoter and its agents associated with this promotion take no responsibility for prizes damaged or lost in transit.
- Costs: Costs associated with accessing the Promotional Websites remain an Eligible Entrant’s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the website by an Eligible Entrant will deem an entry invalid.
- The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
- The use of any automated entry software or any mechanical, electronic or other means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
- Force Majeure: In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any written directions from a regulatory authority made under applicable legislation, the Promoter, in its discretion, reserves the right to either provide an alternative prize to the same or greater value and/or specification as the original prize or to cancel, terminate, modify or suspend the promotion.
- If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to (a) disqualify any Eligible Entrant; or (b) cancel, terminate, modify or suspend the promotion, subject to any written directions from a regulatory authority made under applicable legislation.
- As a condition of accepting the prize, winners must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- Right to verify: The Promoter reserves the right to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right to disqualify any Eligible Entrant for: (a) tampering with the entry process; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Eligible Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Websites or the information on the Promotional Websites , or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Eligible Entrant, the Eligible Entrant agrees to indemnify the Promoter for those losses, damages and costs.
- No liability: The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to Eligible Entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
- Consent to use: As a condition of entering this promotion, an Eligible Entrant consents to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Eligible Entrant agrees that, in the event they are a winner, the Eligible Entrant will participate in all reasonable promoted activities.
- Copyright and privacy: An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about the Eligible Entrant to include the Eligible Entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the Eligible Entrant cannot participate in the promotion. The Eligible Entrant agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media as required under the relevant State or Territory or NZ lottery legislation. - Australian Eligible Entrants: By entering the promotion, Eligible Entrants acknowledge that a further primary purpose for collection of the Eligible Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Eligible Entrant in the future with information on special offers or to provide the Eligible Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact an Eligible Entrant with special offers in this way.
- New Zealand Eligible Entrants: By entering the promotion and opting-in, New Zealand Eligible Entrants agree that the Promoter may use the Eligible Entrant’s personal information to enable the it to use the information to assist the Promoter in improving goods and services and to contact the Eligible Entrant in the future with information on special offers or to provide the Eligible Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
- The laws of Australia apply to this promotion to the exclusion of any other law. Eligible Entrants submit to the exclusive jurisdiction of the courts of Australia.
